Thaler v. Perlmutter Dosyası: Yapay Zekâ Ürünü ve Telif Hakları

2018’de Dr. Thaler, ABD Telif Ofisi’ne başvurarak Yapay Zekâ sistemi vasıtasıyla üretilen “Cennete Yeni Bir Giriş” adlı çalışmanın tescilini talep etti. Ancak Telif Ofisi, bu çalışmanın insan ürünü olmadığı ve zihinsel hususiyet taşıyamayacağı gerekçesiyle başvuruyu reddetti. Dr. Thaler itiraz etti, ancak Ağustos 2023’te mahkeme, Telif Ofisi’nin kararını onaylayarak, Yapay Zekâ tarafından üretilen ürünün sahiplik haklarının Dr. Thaler’a ait olmadığına hükmetti.
In 2018, Dr. Thaler filed a registration request with the U.S. Copyright Office for a work titled “A New Entrance to Paradise,” created through an artificial intelligence system. However, the Copyright Office denied the application on the grounds that the work was not a human creation and lacked mental attributes. Dr. Thaler appealed the decision, but in August 2023, the court upheld the Copyright Office’s ruling, affirming that ownership rights to works produced by artificial intelligence could not be granted to Dr. Thaler.
